On 4 September 2026, Kenya’s Office of the Data Protection Commissioner expects its July 2026 Guidance Note on Artificial Intelligence to start shaping how banks, employers, hospitals, schools, telcos and government agencies deploy AI under the Data Protection Act, Eastleigh Voice reported in a policy explainer.
The note sits beside the National Artificial Intelligence Strategy 2025–2030 (launched March 2025). Strategy language pushes Kenya as a regional AI hub; the ODPC text is the compliance counterweight: innovation is welcome, but algorithms are not above privacy law.
What changes for everyday automated decisions
ODPC stresses transparency when AI plays a significant role in outcomes that hit people — loans, hiring, insurance, education placements, clinical triage. Organisations should offer meaningful human review rather than a dead-end “computer said no.” Explaining reasoning matters more than blaming “the system.”
Using ChatGPT, Claude, Gemini or other overseas platforms does not export legal duty. If personal data leaves Kenya into a cloud model, the local controller still owns the lifecycle risk: contracts, transfers, retention and breach response stay on the Kenyan organisation’s desk.
Bias, public data and black-box culture
The guidance rejects the myth that public internet posts are free training ore. A lawful basis is still required before scraping personal information for AI. It also expects continuous monitoring for discriminatory outcomes in high-stakes domains — recruitment and credit scoring sit at the top of that list.
